These Terms govern the scan conversion and recovery service (the "Service") offered by Swandant to businesses. By submitting files through the website you accept these Terms.

1. Definitions

"Submitted Files" means the files, folders and links you provide to us for the Service. "Results" means the files we produce from Submitted Files. "Derived Data" means data, data sets, measurements, test results and statistics that we derive from Submitted Files or Results.

2. Free Service and Consideration

We provide conversions through the website free of charge. As consideration for the free Service you grant the licence in clause 3 and agree to receive occasional Albireo updates by email under clause 9.

3. Licence to Submitted Files

You grant Swandant a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable and sublicensable licence to store, copy, process, analyse, modify and otherwise use Submitted Files and Results, in particular to develop, test and improve Albireo and our other software and services.

4. Derived Data

We may use anonymised or aggregated Derived Data for any purpose, including commercial purposes, without further obligation to you.

5. Disclosure and Publication

We may disclose Submitted Files and Results to service providers and partners who assist us in processing them. We may publish Submitted Files, Results or excerpts of them, for example as sample data or in articles about our work.

6. Personal Data in Submitted Files

Where Submitted Files contain personal data, such as identifiable persons or vehicle registration plates, we anonymise that data before any disclosure or publication under clause 5.

7. Your Warranties

You warrant that you are entitled to submit the Submitted Files and to grant the licence in clause 3, and that doing so does not infringe the rights of any third party or breach any agreement with a client or other party. You indemnify us against claims arising from a breach of this warranty.

8. Deletion

You may request at any time that we delete the original Submitted Files. We will do so without undue delay. Processing, Derived Data, improvements to our software, test results and any disclosure made before the request are not affected and cannot be reversed.

9. Email Updates

After you confirm your email address, we send you occasional updates about Albireo and the Service. You can unsubscribe at any time using the link in each email; the licence in clause 3 remains unaffected.

10. Feedback and References

We may ask you for feedback on the Service. We may publish feedback you provide, together with your company name, unless you object.

11. No Warranty

Results are provided as is. You are responsible for checking Results before relying on them. The known limits of our software are published on the Albireo page.

12. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In all other cases our liability for the free Service is excluded to the extent permitted by law.

13. Changes

We may amend these Terms with effect for future submissions. The version in force at the time of a submission applies to it.
